New-Product Warranty 

Photo-Sonics, Inc. ("Seller") warrants to Buyer and its customers for a period of one year after Seller's shipment that in normal use the items manufactured by Seller and delivered hereunder will be in substantial conformity with applicable specifications and will be free from defects in material and workmanship.  Seller's obligation and Buyer's and its customers' exclusive remedy for breach of any warranty shall be limited to, at Seller's option, Seller's repair or replacement of any item manufactured by Seller which is disclosed to Seller's satisfaction to be in breach of warranty or Seller's credit to Buyer or its customer therefore at the original purchase price, provided that within thirty days after discovery Seller is given written notice of breach of warranty and the item is returned to the factory of origin, transportation charges prepaid.  Items supplied but not manufactured by Seller are warranted, if at all, only in accordance with the warranty of the manufacturer and are not separately warranted by Seller either as to merchantability or for any particular use.

Items shall be returned to the shipper with transportation charges collect.  No warranty shall apply to any item which has been repaired or altered except as authorized by Seller or which has been subjected to physical or electrical abuse or misuse.  The warranty stated herein is in lieu of all other warranties express or implied and Seller neither assumes nor authorizes any other person to assume for it any other obligation.  Buyer and its customers shall satisfy themselves as to the suitability of the item for their respective intended uses since no item is warranted to be fit for any particular use or application.  In no event shall Seller be liable for incidental or consequential damages of any nature. 

  
     
     
     
 

Warranty on
Spare Parts and Repairs

Photo-Sonics, Inc. ("Seller") warrants to Buyer and its customers for a period of ninety days after Seller's shipment that in normal use the items manufactured by Seller and delivered hereunder will be in substantial conformity with applicable specifications and will be free from defects in material and workmanship.  The warranty for repair of equipment applies only to the parts and labor associated with the repair and does not cover the failure of other components or subsystems which may fail during the warranty period.  Seller's obligation and Buyer's and its customers' exclusive remedy for breach of any warranty shall be limited to, at Seller's option, Seller's repair or replacement of any item manufactured by Seller which is disclosed to Seller's satisfaction to be in breach of warranty or Seller's credit to Buyer or its customer therefore at the original purchase price, provided that within thirty days after discovery Seller is given written notice of breach of warranty and the item is returned to the factory of origin, transportation charges prepaid.  Items supplied but not manufactured by Seller are warranted, if at all, only in accordance with the warranty of the manufacturer and are not separately warranted by Seller either as to merchantability or for any particular use.  Items shall be returned to the shipper with transportation charges collect.
